2024 Non-Practicing Entity global litigation report

Analyzing NPE litigation behavior and outcomes from 2018-2023

In the previous Clarivate™ Non-Practicing Entity (NPE) Report published in 2018, we concluded that patent lawsuits involving NPEs were not only prevalent in the U.S. but also becoming a growing trend in European jurisdictions. This was driven by NPEs seeking out courts where they can further monetize the value of their intellectual property (IP) assets, using litigation as both leverage and means.

This new report seeks to provide an update on the current state of global litigation involving NPEs. We will also evaluate whether the trends observed in the 2018 report, such as the increase in NPEs using forums outside of the U.S. to file infringement cases, have continued.
