introduces a recent remarkable Japanese patent decision in pharma sector.<\/em><\/p>\n<h1><strong>A New Precedent in Japan Pharma Patent Litigation:<\/strong><\/h1>\n<h1><strong>Damages Awarded to a Brand Maker for Loss of Profit Stemming from the Price Reduction after Illegal Gx Entry<\/strong><\/h1>\n<p>Chugai vs Iwaki, Takata, and Pola, on July 27, 2017 (<a href=\"http:\/\/app.darts-ip.com\" target=\"_blank\" rel=\"noopener noreferrer\">darts-116-166-E-ja<\/a>)<\/p>\n<p>On July 27, 2017, the Tokyo District Court ruled in favor of Chugai Pharmaceutical Co., Ltd. in a suit brought by the drug maker seeking damages from a price reduction that was applied after the entry of generic (Gx) drugs that were ruled to have infringed on its brand patent. This is the first judgement of its kind requiring compensation to be paid based on the brand drug price reduction due to illegal Gx entry.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Background:<\/strong><\/p>\n<p>Chugai Pharmaceutical Co., Ltd. (the plaintiff) sells OXAROL\u00ae ointment, a drug for treating skin conditions and owns the process patent (JP3310301) covering the drug. \u00a0Iwaki Seiyaku Co., Ltd., Takata Pharmaceutical Co., Ltd., and Pola Pharma Inc. (the defendants) launched generic versions of OXAROL\u00ae ointment that resulted in the price reduction of the brand drug.\u00a0 The plaintiff had already won an injunction against the Gx manufactures in the Supreme Court on March 24, 2018 (<a href=\"http:\/\/app.darts-ip.com\" target=\"_blank\" rel=\"noopener noreferrer\">darts-815-665-D-ja<\/a>).<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Drug price in Japan:<\/strong><\/p>\n<p>The Japanese pharmaceutical market is highly regulated, with prescription drug prices set by the government under the Ministry of Health, Labour and Welfare (MHLW). \u00a0Drug prices are subject to regular review and revisions to reflect actual market prices. When Gx enter the market, brand drugs receive a further price reduction. In this case, the brand drug price was slashed from JPY 138.00 \/g to 123.20\/g because of Gx entry, which was subsequently ruled to be illegal due to patent infringements.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Awarding patent infringement damages in the pharmaceutical industry:<\/strong><\/p>\n<p>Generally, damages are calculated based on the Civil Code, Article 709. However, in patent litigation, there are special procedures that are defined in the Patent Act, Article 102(1) through 102(3) because of the difficulty in determining the relationship between infringement and damage.<\/p>\n<p>It is very rare for a court to render a decision on damages in brand vs Gx patent infringement litigation because the success rate of the brand maker is very low. \u00a0There was a similar case a decade ago involving Astellas (plaintiff), which had already won an injunction against Taiyo pharmaceutical (Gx manufacture) in the IP High Court on September 10, 2007 (<a href=\"http:\/\/app.darts-ip.com\" target=\"_blank\" rel=\"noopener noreferrer\">darts-822-468-A-ja<\/a>; the Supreme Court dismissed the appeal on December 25, 2007 and the case was finalized), and they also filed a suit with the Tokyo district court seeking damages on the drug price reduction in addition to the damages derived from the market share loss, but the case was eventually settled before the court decided.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Decision:<\/strong><\/p>\n<p>The court confirmed that the lost profit stemming from the market share loss and price reduction are independent, and therefore the plaintiff may seek damages for profit loss based on each factor. The court also held that there is causation between the defendants\u2019 infringements and the lost profit derived from the price reduction, thus the plaintiff may seek whole damages on the lost profit from each defendant.<\/p>\n<p>The court ordered that defendant Iwaki Seiyaku shall pay JPY 203,632,798 (approximately USD 1.85 million); defendant Takata Pharmaceutical shall pay JPY 118,159,458 (approximately USD 1.07 million), and defendant Pola Pharma shall pay JPY 168,223,686 (approximately USD 1.53 million). Additionally, each defendant shall pay five percent a year in interest retroactively from September 15, 2015 until completion of payment to the plaintiff. Furthermore, the defendants Iwaki Seiyaku, Takata Pharmaceutical, and Pola Pharma shall jointly pay JPY 579,169,686 (approximately USD 5.27 million).<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Conclusion and takeaway:<\/strong><\/p>\n<p>This is the first court decision in Japan that confirmed lost profit of the brand maker due to the price reduction after illegal Gx entry, and to award damages. The decision also confirmed that a plaintiff may seek compensation for additional damages for share loss.\u00a0 This case could set a precedent for future litigation between brand and Gx companies in Japan.\u00a0 It might induce reverse payment, that has not come to the surface so far in Japan.\u00a0It should also be noted that the patent enforced here claimed a process. \u00a0This means generic makers should take extra care when conducting an FTO to include process patents.<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>&nbsp;
