{"id":6573,"date":"2020-01-14T07:03:33","date_gmt":"2020-01-14T07:03:33","guid":{"rendered":"https:\/\/www.darts-ip.com\/?p=6573"},"modified":"2024-07-05T16:46:48","modified_gmt":"2024-07-05T16:46:48","slug":"celecoxs-patent","status":"publish","type":"post","link":"https:\/\/clarivate.com\/intellectual-property\/blog\/celecoxs-patent\/","title":{"rendered":"Celecox\u2019s patent does not survive in the IP High Court &#8212; JPO decision overturned &#8212;"},"content":{"rendered":"<h2>Introduction<\/h2>\n<p>A Darts-ip user, Japanese Patent Attorney Ms. Yasuko Tanaka from\u00a0<a href=\"http:\/\/www.english.s-cubecorp.com\/\" target=\"_blank\" rel=\"noopener\"><u>S-Cube Corporation<\/u><\/a>, introduces a recent remarkable Japanese patent decision in the pharma sector.<\/p>\n<p>&nbsp;<\/p>\n<h2>Celecox\u2019s patent does not survive in the IP High Court &#8212; JPO decision overturned &#8212;<\/h2>\n<p>IP High Court, Docket Ref: \u5e73\u621030(\u884c\u30b1)10110, 10112, 10115 on November 14, 2019 (<a href=\"https:\/\/app.darts-ip.com\/\" target=\"_blank\" rel=\"noopener\">darts-881-506-H-ja<\/a>)<\/p>\n<p>&nbsp;<\/p>\n<h3>Background:<\/h3>\n<p>G.D. Searle (currently Pfizer) owns patent JP 3563036 titled \u201cCelecoxib compositions\u201d. Celecox\u00ae\u00a0containing Celecoxib as API, indicated for rheumatoid arthritis and various types of pains, is co-marketed by Astellas and Pfizer. \u00a0The re-examination period of Celecox expired on January 25, 2015, but generics have yet to launch because of the patent.<br \/>\nOn September 30, 2016, Towa Pharmaceutical, one of the largest generic makers in Japan, challenged the validity of the patent and five generic makers joined in support of Towa. The patent survived the first round at the JPO (<a href=\"https:\/\/app.darts-ip.com\/\" target=\"_blank\" rel=\"noopener\">darts-356-505-F-ja<\/a>), however, in the second round, the IP High Court overturned the JPO decision and invalidated the patent.<\/p>\n<p>&nbsp;<\/p>\n<h3>Claimed invention at issue:<\/h3>\n<p>JP3563036<br \/>\nClaim 1:<br \/>\nA pharmaceutical composition comprising particulate celecoxib in an amount of 10 mg to 1000 mg intimately mixed with one or more of pharmaceutically acceptable excipients and one or more discrete solid orally transportable dosage units, wherein D90 of the celecoxib particles at the maximum particle length is less than 200 \u03bcm.<\/p>\n<p>&nbsp;<\/p>\n<h3>Ruling:<\/h3>\n<p>In the JPO, four points at issue; lack of clarity, support and enablement, novelty and inventive step, were discussed. The JPO found that the claimed invention satisfied all the points at issue and ruled the patent was valid.\u00a0Then, Towa and two from the five of the joinders Nipro and Hexal appealed to the IP High Court.<br \/>\nHowever, the IP High Court simply focused on the support requirement and decided the claimed invention was not supported by the description and found the patent invalid.<\/p>\n<p>&nbsp;<\/p>\n<h3>Support Requirement Argument:<\/h3>\n<p>In Japan, the support requirement is stipulated in the Patent Act Art 36(6)1 as \u201cA claimed invention shall be disclosed in the description to prevent a patent from being granted for an invention which is not disclosed to the public.\u201d<br \/>\nThe claimed invention at issue was defined by a numerical limitation. The IP High Court ruled that determining whether the support requirement of an invention with numerical limitations has been met should be based on whether or not a person skilled in the art could understand how to solve the problem of the invention in all the ranges numerically limited.\u00a0The court found that the support requirement was not met because a skilled artisan, based on the common technical knowledge at the time of filing, could have understood how to solve the problem of the invention, that is \u201cto provide a pharmaceutical composition comprising a solid orally transportable celecoxib particles with improved bioavailability\u201d in some, but not all, the ranges where \u201cD90 of the celecoxib particles at the maximum particle length is less than 200 \u03bcm.\u201d<\/p>\n<p>&nbsp;<\/p>\n<h3>Takeaways:<\/h3>\n<p>In this case, an inadequate support requirement was enough for invalidation, reflecting a recent trend in Japan, as discussed in my columns in 2019, upon which invalidations are being determined simply by a violation of the written description requirements such as support and enablement. Further, this case shows us that we need to be mindful that the support requirement for numerically defined inventions is quite strict.<\/p>\n<p>A recent trend of the IP High Court decisions in the pharmaceutical field has been the increase in cases where the support requirement is discussed.<\/p>\n<div align=\"center\"><img decoding=\"async\" class=\"alignnone wp-image-6574\" src=\"http:\/\/clarivate.com\/wp-content\/uploads\/sites\/5\/2020\/01\/English-Fig.png\" alt=\"Celecox\u2019s patent does not survive in the IP High Court -- JPO decision overturned --\" \/><\/div>\n<p>There were 2 cases in 2016 (1 found to meet the support requirement, 1 in violation), 3 cases in 2017 (2 met the requirement, 1 in violation), and 18 cases since 2017 (12 met the requirement, 6 in violation)*.
