{"id":41488,"date":"2020-01-02T19:57:44","date_gmt":"2020-01-02T19:57:44","guid":{"rendered":"https:\/\/clarivate.com\/derwent\/?p=41488"},"modified":"2024-07-05T16:46:49","modified_gmt":"2024-07-05T16:46:49","slug":"looking-back-intellectual-property-highlights-from-2019-2","status":"publish","type":"post","link":"https:\/\/clarivate.com\/intellectual-property\/blog\/looking-back-intellectual-property-highlights-from-2019-2\/","title":{"rendered":"Looking back: Intellectual property highlights from 2019"},"content":{"rendered":"<p>As we look forward to a new year, my colleagues and I at Clarivate Analytics wanted to share our selection of the most significant intellectual property related events from 2019 involving patents, trademarks, copyrights and domain names.<\/p>\n<p>In no particular order, here are our top ten IP highlights from 2019:<\/p>\n<ol>\n<li class=\"mb-4\">The United States Supreme Court agrees to hear oral arguments in the case of the <a href=\"https:\/\/www.scotusblog.com\/2019\/11\/justices-grant-governments-trademark-petition\/\" rel=\"noopener noreferrer\" target=\"_blank\">US Patent Trademark Office vs. Booking.com<\/a>. The Supreme Court will decide if operating an online business that uses a top-level domain (.COM) in combination with a generic term creates a protectable trademark.<\/li>\n<li class=\"mb-4\">Canada joins the <a href=\"https:\/\/www.wipo.int\/madrid\/en\/news\/2019\/news_0018.html\" rel=\"noopener noreferrer\" target=\"_blank\">Madrid System for trademark registration<\/a>,  creating greater efficiency and lowering costs for trademark owners seeking trademark protection in Canada and more than 100 other countries around the world.<\/li>\n<li class=\"mb-4\">The copyright registrations for a significant number of cultural works expired this year allowing them to enter the <a href=\"https:\/\/abovethelaw.com\/2019\/01\/celebrating-public-domain-day-2019\/?rf=1\" rel=\"noopener noreferrer\" target=\"_blank\">public domain<\/a>, the first to do so in more than 20 years. Works include Kahlil Gibran\u2019s book, <em>The Prophet<\/em>, Cecil B. DeMille\u2019s film, <em>The Ten Commandments<\/em>, and several compositions by Louis Armstrong, George Gershwin and John Philip Sousa.\n<div class=\"text-center small mt-4\">\n<img decoding=\"async\" src=\"http:\/\/clarivate.com\/intellectual-property\/wp-content\/uploads\/sites\/5\/2020\/01\/Kahlil_Gibran_-_The_Prophet_01.png\" \/><br \/>\nKahlil Gibran\u2019s book, <em>The Prophet<\/em> entered the public domain in 2019.<br \/>\nSource: Scan of <em>The Prophet<\/em> by Kahlil Gibran, published in 1923.<\/div>\n<\/li>\n<li class=\"mb-4\">The China National Intellectual Property Administration formally announced newly amended <a href=\"https:\/\/www.natlawreview.com\/article\/new-china-patent-examination-guidelines-effective-november-1-2019\" rel=\"noopener noreferrer\" target=\"_blank\">patent examination guidelines<\/a>. These introduce welcome flexibility to patent prosecution practice, and address many common patent applicant frustrations in China.<\/li>\n<li class=\"mb-4\">The ICM Registry announced <a href=\"https:\/\/adultblock.icmregistry.com\/\" rel=\"noopener noreferrer\" target=\"_blank\">AdultBlock<\/a>, a brand protection feature that allows trademark owners to more easily protect their brands across all four adult-themed top level domain names (.SEX, .PORN, .XXX, and .ADULT).<\/li>\n<li class=\"mb-4\">The U.S. Patent and Trademark Office (USPTO) introduced a new filing rule requiring foreign applicants to appoint a <a href=\"https:\/\/www.uspto.gov\/trademark\/laws-regulations\/trademark-rule-requires-foreign-applicants-and-registrants-have-us\" rel=\"noopener noreferrer\" target=\"_blank\">U.S. based qualified legal representative<\/a> for all trademark applications. This rule was meant to reduce the number of high volume, low quality filings coming from applicants in China and elsewhere.<\/li>\n<li class=\"mb-4\">Baby Yoda! The popularity of Baby Yoda featured in <em>The Mandalorian<\/em> television series took Disney by surprise. The market was soon flooded with infringing merchandise, forcing Disney to scramble to <a href=\"https:\/\/www.plagiarismtoday.com\/2019\/12\/19\/the-battle-over-baby-yoda\/\" rel=\"noopener noreferrer\" target=\"_blank\">protect its copyright interests<\/a> in the <em>Star Wars<\/em> character.\n<div class=\"text-center small mt-4\">\n<img decoding=\"async\" src=\"http:\/\/clarivate.com\/intellectual-property\/wp-content\/uploads\/sites\/5\/2020\/01\/yoda-4708878_1920.jpg\" class=\"img-fluid\" \/><br \/>\nThe popularity of Baby Yoda led to numerous cases of copyright infringement.<br \/>\nSource: Artist\u2019s interpretation free for commercial use by <a href=\"https:\/\/pixabay.com\/users\/_freakwave_-12222786\/?utm_source=link-attribution&amp;utm_medium=referral&amp;utm_campaign=image&amp;utm_content=4708878\" rel=\"noopener noreferrer\" target=\"_blank\">_freakwave_<\/a> from <a href=\"https:\/\/pixabay.com\/?utm_source=link-attribution&amp;utm_medium=referral&amp;utm_campaign=image&amp;utm_content=4708878\" rel=\"noopener noreferrer\" target=\"_blank\">Pixabay<\/a>.\n<\/div>\n<\/li>\n<li class=\"mb-4\">The USPTO issued revised <a href=\"https:\/\/www.uspto.gov\/about-us\/news-updates\/us-patent-and-trademark-office-announces-revised-guidance-determining-subject\" rel=\"noopener noreferrer\" target=\"_blank\">patent subject matter<\/a> eligibility guidance aimed at improving the clarity, consistency and predictability of patent eligible subject matter (35 U.S.C. \u00a7\u00a7101 and 112) throughout the USPTO.<\/li>\n<li class=\"mb-4\">E-commerce giant Amazon finally <a href=\"http:\/\/domainincite.com\/25094-amazon-beats-south-america-dot-brand-contracts-now-signed\" rel=\"noopener noreferrer\" target=\"_blank\">prevailed in its seven-year battle<\/a> with South American countries that border the Amazon River to register and operate the .AMAZON top level domain name (TLD). This decision by the Internet Corporation for Assigned Names and Numbers (ICANN) is viewed as good precedent by other brand owners that may wish to apply for their own .BRAND TLD in the future<\/li>\n<li class=\"mb-4\">In an effort to lessen trade war tensions between Mainland China and the United States, China agrees to <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2019-11-24\/china-to-raise-penalties-on-ip-rights-violations\" rel=\"noopener noreferrer\" target=\"_blank\">raise penalties<\/a> for individuals who are found to have infringed trademarks, copyrights, patents and other forms of intellectual property.<\/li>\n<\/ol>\n<p>Clarivate is a global leader in providing trusted patent, trademark and domain data and solutions across our brands Derwent\u2122, CompuMark\u2122, MarkMonitor\u2122, Techstreet\u2122 and Darts-ip\u2122.
