Introduction<\/h2>\n

The Faceshop<\/em> cosmetics that applied ‘parody’ design to Louis Vuitton<\/em> were found to infringe the trademark rights of Louis Vuitton <\/em>(Seoul Central District Court, 2018.10.4., 2016\uac00\ud56936473). The court judged that even if a company uses a parody design of luxury goods, if the parody intention is not clear, it has the intention to infringe the trademark right. The Faceshop<\/em> signed a collaboration agreement with the American bag brand ‘My Other Bag’<\/em> in 2016 and launched a cushion cosmetics product with a design similar to ‘LV Monogram’, a typical Louis Vuitton<\/em> design. My Other Bag <\/em>is a brand that sells cloth bags that display luxury handbag illustrations on one side of the bag, and prints the phrase ‘My Other Bag’ on the other side in order to parody the pursuit of luxury goods. Louis Vuitton<\/em> has filed a lawsuit claiming that “The Faceshop<\/em> has violated the brand’s reputation by using LV monograms in its cosmetics without permission.”<\/p>\n

What is Trademark parody?<\/h2>\n

The parody of a trademark is a change in the content or form of one trademark by another’s trademark so that the parodying trademark\u2019s owner may criticize, satire or mock the product. It is not a mere imitation, but a means of communicating ideas and expression of ideas that provides criticism or sarcasm while caricaturing the theme or image of an existing trademark. The parody of trademark needs to be protected in listed cases by the freedom of expression even if it is used commercially and attached in products being sold: (a) if the parody of trademark corrects consumers\u2019 distorted information about a product, (b) when the parody provides a new idea and plays a positive role in contributing to the public good such as consumers\u2019 public health, (c) when the purpose of the parody is not in using the trademark owner\u2019s credit, but rather in giving laughter and humor by satirizing or criticizing famous trademarks.\u00a0 However, parody of a trademark will reflect the original trademark – subject of criticism or satire – so the parody of the trademark may lead to the loss of the reputation or distinctiveness of the original trademark although there is little possibility for confusion in the field of the trademark law. \u00a0 Therefore, in judging whether or not the parody of trademark is used fairly, one should compare the benefit of the parodist who intends to use the trademark and the public interest between the trademark owner\u2019s disadvantage and consider if it complies with fair trade practices. \u00a03. Comparison with USA case<\/strong> \u00a0 Louis Vuitton <\/em>has filed a trademark infringement lawsuit in the Southern District Court of New York against the My Other Bag<\/em> for the “zoey toanl brown” product of My Other Bag<\/em>, which dilutes its trademark. In 01\/01\/2016, the plaintiff’s claim was rejected because the court judged it was not a dilution.<\/p>\n

According to the court\u2019s decision above, The Faceshop<\/em> claimed that the design of My Other Bag<\/em> in its products is also a parody, but it was not accepted. The judge said, “The Faceshop<\/em> claims that the cosmetic design of the collaborative My Other Bag<\/em> is a parody of luxury goods, but it is not a brand with a high level of recognition\u2026Considering the social and cultural background and general English level, \u2018My Other Bag<\/em>\u2019 does not seem to convey a special commentary.”\u00a0<\/em>\u201c<\/em>Considering the social, cultural background and general English level of our country, \u2018My Other Bag\u2019 simply has the meaning of ‘my other bag’ to the general public as well as general consumers in our country and does not seem to convey the special commentary meaning as defendant claims.”<\/em> (source: darts-ip decision: 6115586)<\/em>\u00a0\u201cUnlike My Other Bag<\/em> which prints illustrations and letters on each side, The Faceshop<\/em> products are marked on the same side, so the intention of the costume is not revealed,” the court said. “The Faceshop<\/em> repeatedly displayed a design similar to Louis Vuitton<\/em>, so it is difficult to see that the creative elements of The Faceshop<\/em> have been added. ” The court found that the The Faceshop<\/em> usage of Louis Vuitton<\/em>‘s design undermines the design’s distinctiveness and calculated the damages to be 50 million won<\/p>\n\n\n\n\n\n\n\n\n\n

Implications<\/h2>\n

The court judged that \u201cThe defendant\u2019s use of the use mark may weaken a power as a unique and unambiguous source indication of the good marker widely recognized in the country as a trademark of the plaintiff or decrease the attractiveness of the customer. Thus, the defendant’s use of the use marks to produce and sell each of the products in this case constitutes an act that impairs the distinctiveness of the good mark(source: darts-ip decision: 6115586).\u201d \u00a0 The court further stated that \u201cThe defendant intends to take advantage of the reputation and reputation of this case product mark and does not convey the same commentary meaning as the defendant claims to the general public or consumers of our country. The defendant ‘s use of the use mark is not considered to be a fair use as a parody of the trademark, because the usage causes dilution of the plaintiff’s mark in this case(Ibid).\u201d \u00a0 The case implies even if one uses a parody design of luxury goods, if the parody intentions are not clear, the parodied TM should be considered to have infringed the trademark rights. The ruling confirms that if the creative elements such as criticism or special commentary meanings are not added, it will not be recognized as a parody and will be liable for damages in violation of the Unfair Competition Prevention Law. It is important to note that the intention of the parody and the creative elements of the parody are the most important factors in recognizing it as a parody.<\/p>\n
